Course Property Development: Tips Traps and Techniques


Buying a site to develop involves much more than the usual conveyancing procedures, and this course looks at the common non-title issues that are vital if you are going to deal with this work successfully. With a number of practical examples, exercises and puzzles to solve, you will be able to deal with such matters with confidence.

  • The Big Picture - communication and reporting issues
  • Let’s get physical - what’s on the ground? Unexpected SDLT consequences
  • Plans, site surveys and gaps. The individual pieces of the jigsaw: What are the boundaries of each piece? Identification and presumptions affecting boundaries. ‘No-mans’ land or ransom strip? Can (or should) you claim adverse possession? Does someone else claim part of the site or rights over it?
  • Searches points - reading between the lines
  • Environmental - more to it than a ‘search’
  • SDLT planning points
  • Planning, S.106, CIL, conditions, open spaces
  • Highway access, vision splays, and related issues. - does it abut a highway, or is it a private right of access? Identifying the highway boundary and presumptions affecting this. Can you use the prescriptive or express rights of access enjoyed by one or more pieces?
  • Rights of way/services, s.62 and easements points. What prescriptive or express easements do you have and can all the pieces use them? Enlargement of easements - what statutory powers can you invoke?
  • Other constraints - TPOs, Restrictive covenants, Rights of light, etc. Flora and fauna - badgers, newts, weeds, etc.
