Course Certificate in Commercial Property Litigation: Part One


This course is aimed at lawyers from a contentious background who are looking to build a practice in commercial property litigation. It will not deal with residential property disputes save in the context of mixed use developments.

The course will provide a useful overview of the Landlord and Tenant Act 1954 from which much of the bread and butter work of the commercial property litigator flows. The 1954 Act contains many traps for the unwary. The course will also focus on some of the most common areas in which disputes arise - service charges, enforcement of leasehold covenants and break options.

The course will include:

  • The basic concepts of 1954 Act- What is a “business lease”? Who is the “competent landlord”?
  • Statutory notices under 1954 Act
  • Overview of court procedure- interim rent and renewal terms
  • Service charges- the Code and s 20 consultation in mixed use developments
  • Enforcement of leasehold covenants - the pre 1996 and post-1995 regimes
  • Break options- drafting and serving notices, payment of rent and interest, conditional clause
