This course builds on An Introduction to Commercial Property Litigation - Part One. Both courses are aimed at lawyers from a contentious background who are looking to build a practice in commercial property litigation. The course will not deal with residential property disputes.
While Part 1 focused on the Landlord and Tenant Act 1954 in relation to uncontested lease renewals, this course considers procedures where the landlord opposes lease renewal on redevelopment grounds. Dilapidations claims, which are increasingly prevalent, are covered in some depth, while the course also addresses contentious applications for landlord’s consent to dealings with the lease, practicalities of trespasser eviction, and remedies specific to property litigation (forfeiture and distress/CRAR).
