The course rounds up recent significant developments in commercial property litigation and considers the practical implications. It is aimed at all those advising on commercial property disputes, whether their client base is predominantly investors and developers, or occupiers. It is suitable for the general practice property adviser as well as the specialist property litigator.

  • Break options - conditions for exercise, formalities and practicalities as well as new case law on the service of notices
  • Contractual interpretation of commercial property documentation including rent concession agreements, rent review clauses and service charges
  • Landlord and tenant issues before the courts, including a flurry of cases on the grant of relief from forfeiture, new decisions on landlord’s consents, quiet enjoyment and landlord’s building works, and further judicial pronouncements on the validity of assignment of leases to guarantors
  • Business rates including Supreme Court cases and rates avoidance schemes
  • Key issues for developers including interference with easements (particularly rights of light), and private nuisance
