Course Conveyancing Issues in Wales


Increasing areas of property related law are being delegated to the Welsh Government; in particular in April 2018 Land Transaction Tax will replace Stamp Duty Land Tax. The course is of great importance for anyone dealing with conveyancing matters in Wales. In particular, conveyancers based in England need to appreciate the changes to avoid potential claims when working for clients who are purchasing in Wales. The course aims to look at some of the areas of devolution and contrast them with the law in England.


Topics covered include:

  • Land Transaction Tax which replaces SDLT in April 2018. The Land Transaction Tax Bill 2016-17 is currently in front of the Welsh Parliament.
  • The Rent in Homes (Wales) Act 2016 and the end of assured shorthold tenancies. Assured and assured shorthold tenancies, together with residential licences are due to be replaced by occupation contracts whereby a standard agreement must be presented to the occupiers.
  • The Housing (Wales) Act 2014 and the registration of leases, training courses and other changes to housing legislation.
  • The Planning (Wales) Act 2015 and changes to planning enforcements and also the registration of town and village greens.
  • Differences in permitted development in England and Wales
  • Septic Tank registration where the registration requirements differ in England & Wales.
  • Differences in relation to the adoption of sewers where as of 2013 the adoption process in relation to new builds and new connections differs.
