Course Lease Management Documents: Getting the Basics Right

Clients expect lease management to be done with a minimum of fuss and expense and it is often delegated to junior or unqualified staff.

However, it is vital that lawyers do not cut corners with routine documents and are able to identify when bespoke drafting is required.

Mistakes made with landlord’s licences, deeds of variations and even the humble rent review memorandum can have serious consequences. Getting things wrong may not only expose clients to damages claims, but can inadvertently release guarantors, confer security of tenure and increase SDLT liability.

This course is designed for property lawyers handling general landlord and tenant matters and property management. It examines the key risks emerging from standard lease documentation and explains how they can be mitigated. You will also be given the chance to practise drafting and receive feedback from the experienced trainer.

Topics covered include:

  • The unintended consequences of lease variations, and spotting disguised variations
  • Adding to the demise by supplemental leases
  • Adding to the term by reversionary leases
  • Formalities of documentation
  • Issues in relation to contracting-out
  • Managing requests for further information
  • Avoiding the grant of informal consent
  • Assessing a ‘reasonable time’
