Course Procurement - Choosing the Winning Tender

This introductory course is aimed at legal advisers to public authorities, including those in private practice, who are new to public procurement.

The course focuses on two aspects of the procurement process which are critical to a successful outcome: qualification of bidders and evaluation of tenders. It will explain both public authorities’ obligations under the public procurement rules (Public Contracts Regulations 2015 and Concession Contracts Regulations 2016) and relevant UK procurement best practices.

The course will also examine EU and UK case law which has an increasing impact in these areas.

The aim is to enable you to give advice which will lead to sound decisions and which will help mitigate legal risks.

In particular, the course will cover:

  • Choosing the right procedure and designing the procurement process
  • Understanding exclusion grounds and selection criteria
  • Using the standard selection questionnaire/ESPD
  • Developing contract award criteria and an evaluation methodology
  • Resourcing the team and managing the evaluation process

‘Hands-on’ experience will be provided through exercises using practical examples.
