Course Public Procurement: Preparing for Brexit

This course will familiarise you with the impact of Brexit on the UK’s public procurement regime and the UK’s options for the future of that regime. It will equip you to advise clients on the changes which might come about, when they are likely to take effect and the appropriate response.

The course is aimed at:

  • Lawyers working in the public sector,
  • Those in private practice advising public sector clients and bidders, and
  • Counsel employed by companies bidding for public sector contracts.
Participants should have at least an intermediate level of understanding of the current EU public procurement rules.

Specifically, the course will cover:

Brexit options and implications for UK public procurement

  • EEA – the discarded ‘Norway’ model?
  • Free Trade Agreement – the preferred outcome
  • WTO rules only – the fall back option
Public procurement provisions in Free Trade Agreements
  • Sectoral agreement (the ‘Switzerland’ model)
  • CETA (the ‘Canada’ model)
  • DCFTA (the ‘Ukraine’ model)
The common core: The WTO Agreement on Government Procurement (GPA)
  • History and overview of the GPA
  • The UK’s status in the GPA
  • Comparison of GPA with EU public procurement directives
The Great Repeal Bill and the ‘domestication’ of EU public procurement law including the future of CJEU case law
  • Timing of changes: withdrawal agreement, transitional arrangements and trade agreement
