Overview


This webinar will provide an overview of the law relating to limitation, in particular looking at the limitation periods and when time starts to run in a variety of common claims. Particular attention will be paid to difficult areas such as the “date of knowledge” in personal injury claims.

We will then move on to consider strategies that may be used when a claim is out of time and thus can only proceed at the discretion of the court. We will look at the relevant statutory provision (section 33 of the Limitation Act 1980) and subsequent case law to consider how best to approach an application for discretion.
