Webinar Contracting-Out of the Landlord and Tenant Act 1954 - Deceptively Simple? - On-demand webinar

Overview

This webinar is essential viewing for all property litigators and commercial property lawyers.

One of the most welcome of the reforms made to the 1954 Act in 2003 was doing away with any court involvement in the contracting-out process. The notice and declaration procedure which was introduced instead looked on the face of it to be much simpler and quicker, and within the control of the parties. As the implications sank in, however, a number of hidden difficulties and complexities began to appear. Getting contracting-out right can be crucial; it may underpin the property valuation, or it may vitally affect practical plans for the property. You need to understand the technicalities, particularly as regards structuring more complex transactions, but also the everyday stuff.

This webinar will consider:

  • The paper trail: proving that the lease was properly contracted-out
  • Agreements for lease
  • Pre-completion amendments to the form of lease
  • Put and call options
  • Guarantor issues and procedure upon assignments
  • Offer-back clauses
  • Issues with surrender agreements
