Webinar Injunctions in Commercial Property - When Damages Are Not the Right Answer - On-Demand Webinar

Overview

This webinar is relevant for anyone who practises in commercial property, whether acting for landlord investors, occupiers or developers.

If your rights to light are interfered with, if you’re suffering from noise nuisance, if your tenant has sublet the premises without consent, an award of damages is often not going to give you what you want. The field of commercial property context contains a number of discrete recurring situations in which claims for an injunction involve considerations unique to themselves, and in which alternative statutory or common law procedures may also offer a useful way forward. This webinar will consider the application of the principles surrounding the grant of an injunction, and the award of damages in lieu, in a variety of common situations.

The webinar will include:

  • Injunction or damages in lieu? What is the current state of the law?
  • The strange case of the keep-open covenant
  • Restraining interference with easements
  • The Crestfort v Tesco injunction
  • Basis for assessing damages in lieu
  • Nuisance claims after Coventry v Lawrence
