Webinar Landlord & Tenant Act 1954, Part II - Module 1 - The Foundations of the Act - On-Demand Webinar

This webinar is one of a series aimed at the junior lawyer whose caseload will feature the business security of tenure regime under the Landlord and Tenant Act 1954. It will also act as a refresher for the more experienced lawyer.

The 1954 Act is fundamental to the functioning of the commercial property market in England and Wales, and yet its degree of technicality means that it is often imperfectly understood. The opportunities for costly mistakes are legion. To speak the language of the Act it is necessary to have a good understanding of the basic concepts which underlie it; indeed, it is practically impossible to talk about the Act without understanding those concepts thoroughly. This webinar equips the practitioner with an understanding of those key concepts, and forms the foundation for operating the Act to the client’s best advantage.

The webinar will include:

  • What “business” use qualifies?
  • The importance of occupation
  • Identifying the “holding”, and its relevance
  • Key dates in the procedure: contractual expiry, notice expiry, actual expiry
  • Identifying the “competent landlord”
