Webinar Landlord & Tenant Act 1954, Part II - Module 3 - Lease Renewals in Court - On-Demand Webinar

This webinar is one of a series aimed at the junior lawyer whose caseload will feature the business security of tenure regime under the Landlord and Tenant Act 1954. It will also serve as a refresher for more experienced lawyers.

The available types of court application in the lease renewal process present a variety of ways in which the issues in any particular case may be brought before the court, and there are tactical and timing considerations underlying the choice as to which party initiates proceedings and when. Once proceedings have begun, their conduct is shaped by the anomalous nature of lease renewal proceedings, considered as a type of litigation. The parties have not chosen to refer a dispute to court for resolution, but are in court because they are statutorily required to be there. The outcome does not identify a ‘winner’ and ‘loser’, but the terms of a multi-layered commercial transaction. The webinar outlines the important procedural considerations.

The webinar will include:

  • The nature of the available applications, and who can apply when
  • Time limits and extensions of time
  • Typical case management directions
  • Costs and formal settlement offers
  • How to avoid becoming bound by concessions in settlement negotiations
  • The role of expert witnesses
