The available types of court application in the lease renewal process present a variety of ways in which the issues in any particular case may be brought before the court, and there are tactical and timing considerations underlying the choice as to which party initiates proceedings and when. Once proceedings have begun, their conduct is shaped by the anomalous nature of lease renewal proceedings, considered as a type of litigation. The parties have not chosen to refer a dispute to court for resolution, but are in court because they are statutorily required to be there. The outcome does not identify a ‘winner’ and ‘loser’, but the terms of a multi-layered commercial transaction. The webinar outlines the important procedural considerations.
