Overview


This course considers the new duty under the Care Act for a local authority to investigate possible abuse, and the possible use of the provisions of the Care Act to safeguard an individual. It will also consider ways of gaining access to someone who is at risk. The position in England will be compared with the provisions in Wales.

The course will cover:-

  • The well-being provisions in section 1;
  • The duty to co-operate in sections 6 and 7;
  • The assessment of need for the individual;
  • The assessment of need for a carer;
  • Refusal of an assessment;
  • The duty to investigate under section 42;
  • Safeguarding and advocacy under section 68;
  • The statutory guidance on safeguarding
  • Ways of gaining access to property where it is feared someone is at risk;
  • The position in Wales and how it differs from the position in England.
