Overview


An area of great concern to many parents of someone with a learning disability or other special need is how to provide for their loved one after they die. This webinar looks at the various options for setting up a suitable trust either in a will or during the settlor’s lifetime and will cover the following topics:

  • The types of trust that are available, with a particular emphasis on discretionary trusts and disabled person’s trusts set up in compliance with Section 89 of the Inheritance Tax Act 1984
  • Addressing the main concerns of parents: implications for means tested benefits; role of Court of Protection; tax implications; costs and difficulties of managing a trust
  • Key issues for parents to consider: choice of trustees, choice of beneficiaries, letter of wishes, conflicts of interest between trustees and beneficiaries.
  • Managing a trust with a learning disabled beneficiary.
